These Terms and Conditions (“Terms”) apply to everyone using the Pilates Academy® website (https://www.pilatesacademydubai.com), the Pilates Academy® App, or participating in any of our in-studio sessions, online programs, workshops, equipment purchases, or training certifications. By using our platforms or engaging in our services, you agree to these Terms.

If you do not accept these Terms, please refrain from using our services.

Agreement Overview

This agreement is between you (the User) and Pilates Academy®, the owner and operator of this website. Your agreement to follow and be bound by the sections listed below is considered effective from your first use of our website. Some clauses specifically apply to paid services (Clauses 3 and 12–14), while the rest apply generally.

Please note: nothing on our website should be interpreted as a contractual offer. When you place an order, it constitutes an offer on your part. A contract between us becomes valid only once we confirm acceptance by email.

1. Definitions

Here’s what we mean by some of the terms used throughout this document:

• “Account”: Your personal profile, including login details, contact info, and payment method used to access services or content on our site or app.
• “Content”: Any text, images, videos, graphics, software, or media available through the site or app.
• “Facilities”: Any tools, features, or platforms we make available online for your use.
• “Services”: Everything we offer through the site and app – this includes training programs, online content, equipment info, class bookings, and the use of our e-learning platform.
• “Payment Information”: Credit/debit card details or other billing information required to process transactions.
• “Premises”: Our physical location at Jumeirah Bay X2 Tower, Suite 4202, JLT, Cluster X – Dubai, UAE.
• “System”: Any communication tools hosted on our website or app (e.g., email forms, chat boxes).
• “User(s)”: Anyone accessing the website or app who is not employed by Pilates Academy® and acting in the course of their employment.
• “Instructor“: Any certified individual delivering classes, workshops, or educational content on behalf of Pilates Academy®.
• “Digital Services“: Any on-demand, pre-recorded, or live-streamed content provided through the Pilates Academy® platform or app.
• “Website”: The Pilates Academy® website and any official subdomains.

“We” / “Us” / “Our”: Pilates Academy®, a company registered in the UAE under Trade License DMCC-083863, based at the address above.

2. Age Requirements

You must be at least 18 years old to use our services independently. If you’re under 18, you must be supervised by a parent or guardian. Any payment information must be submitted by an adult or with their explicit permission. See also Clause 16.7 for more on service eligibility.

3. User Responsibilities

When you use our website, app, or services, you agree to:

• Keep your login credentials secure and use strong passwords.
• Avoid any activity that may damage, disable, or impair the website or app.
• Respect the privacy, rights, and experience of other users.

You are solely responsible for anything that happens through your account.

4. Acceptable Use and Limitation of Access

We expect all users to use our platforms responsibly. You must not:

• Try to interfere with our systems or security features.
• Upload or distribute malicious code or engage in activities that breach UAE law.
• Access or attempt to access areas or systems you’re not authorized to use.

5. Indemnity

By using our services, you agree to indemnify and hold harmless Pilates Academy®, its directors, team members, partners, and affiliates from any claim, liability, damage, cost, or expense (including legal fees) arising from, including but not limited to:

• Your use or misuse of the platform.
• Your breach of these Terms.
• Any violation carried out via your account, whether by you or someone using your account without authorization.

6. Business Clients

These Terms apply equally to individual users and businesses. If you’re purchasing services on behalf of a company or client, you’re responsible for ensuring compliance on their behalf.

7. Intellectual Property

All content on our website and app – including images, branding, text, videos, software, and design – is protected by copyright and intellectual property laws. Unless clearly indicated otherwise, this content belongs to Pilates Academy® or its partners.
You may not copy, share, republish, or use our content in any form without written permission.

8. Third-Party Intellectual Property

Certain product images, content, or service references may belong to third-party suppliers or manufacturers. You may not reproduce or use any of their materials unless specifically authorized by them.

9. Fair Use of Intellectual Property

Material from the Pilates Academy® website may only be reused without written authorization where permitted under applicable copyright law. Specifically, the exceptions outlined in Chapter III of the Copyright, Designs and Patents Act 1988 may apply to certain uses such as private study, non-commercial research, or quoting with attribution.

This allowance does not grant blanket permission to reuse, copy, or modify any part of our content, especially training materials, videos, downloads, or curriculum.

10. Licenses for Content

All content provided on our website, the Pilates Academy® App, or through any of our online platforms is intended for use by verified users only.

By accessing our platform, you agree to the following:

• You may not share, copy, reproduce, distribute, alter, or adapt any educational content –  including videos, manuals, course presentations, templates, or assessments  –  without written permission from Pilates Academy®.
• You may not use our materials to build derivative training programs or teacher certifications.
• You may not translate or republish content for commercial or public use.
• Any breach of this policy may result in suspension or permanent termination of access, without refund.

We take the integrity of our educational resources seriously and protect them under international intellectual property law. Any unauthorized reproduction or commercial exploitation may also result in legal action under UAE and international IP law.

11. Compliance with Export Control Laws

All content, materials, and digital services offered through the Pilates Academy® website and app are provided in compliance with UAE export control regulations. You may not export, share, or transmit any part of our content to a location or individual subject to UAE sanctions or international embargoes.

You are solely responsible for ensuring that your access to and use of our platform complies with the laws in your jurisdiction. If you’re located outside the UAE, it is your responsibility to verify local restrictions regarding educational content, fitness services, and digital media imports.

12. Links to Other Websites

This website may include links to third-party websites. These links are provided for your convenience and additional information. Unless expressly stated, these external sites are not under the control of Pilates Academy®, and we do not endorse or assume responsibility for the content, privacy policies, or practices of any linked website.

We accept no liability for any loss or damage that may arise from your use of third-party sites.

Please be mindful when leaving our site, and we recommend reviewing the terms and privacy policies of any website you access via external links.

13. Links to This Website

If you would like to link to the Pilates Academy® website, you may do so under the following conditions:

• Links must direct to our homepage (https://www.pilatesacademydubai.com) unless you have received our written permission for deep linking to specific internal pages.
• Links must be fair, legal, and clearly marked as referencing Pilates Academy®.
• You may not link in a way that implies association, endorsement, or approval where none exists.
• You may not embed our content within other websites (e.g., via iframes) without consent.
• Linking sites must not contain offensive, defamatory, or unlawful content.

We reserve the right to withdraw linking permissions at any time, without prior notice, if these conditions are breached.

14. Use of Communications Facilities

14.1 The Pilates Academy® website and app may include communication tools such as contact forms, live chat features, email links, or feedback portals. By using these systems, you agree to follow the rules below. Failure to comply may result in suspension or permanent removal of your account.

14.1.1 You must not use obscene, threatening, defamatory, or discriminatory language.

14.1.2 You must not submit unlawful, harmful, or objectionable content.

14.1.3 You must not promote, incite, or glorify violence.

14.1.4 We kindly request communications in English whenever possible, as responses in other languages may be delayed or unavailable.

14.1.5 You may not impersonate another person, especially staff, affiliates, or representatives of Pilates Academy®.

14.1.6 You may not use our communication systems to distribute spam, advertisements, or any kind of bulk unsolicited communication.

14.1.7 You agree that your submissions are respectful, relevant, and do not infringe on the rights of others.

14.2 Pilates Academy® reserves the right to monitor and store any communication submitted via our systems. This may include correspondence via email, live chat, or message forms submitted through the website or app.

14.3 We may retain and, where legally or operationally required, review communications sent to us via these platforms. This may be for customer service tracking, internal training, dispute resolution, or legal compliance.

14.4 If you submit any feedback, reviews, testimonials, or suggestions through our systems, you grant Pilates Academy® the right to use that content – with your permission – for marketing, education, or service development purposes. You also waive any moral rights to be identified as the author of such content unless otherwise agreed.

If you have specific limitations you’d like to apply to any feedback or communication you share, please let us know in writing at the time of submission.

15. Account Termination and Cancellation

15.1 Either you or Pilates Academy® may terminate your account at any time. If we choose to terminate your account, we will notify you via email and, where appropriate, provide the reason for termination. However, we reserve the right to close an account without explanation if deemed necessary to protect the integrity of our platform, our team, or other users.

15.2 If your account is terminated, any pending orders, access to active services, or payments will be canceled. You will no longer have access to your personal dashboard, course materials, booking history, or digital certifications unless otherwise agreed.

15.3 We also reserve the right to temporarily suspend accounts under investigation for policy breaches, unauthorized use of materials, or misuse of the platform, until the matter is resolved.

15.4 Pilates Academy® reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate your access to the website, classes, services, or any part thereof, without prior notice, if:

• You breach or violate these Terms and Conditions, studio policies, or any applicable laws;
• You engage in behavior that is abusive, threatening, disruptive, or harmful to staff, other clients, or the studio environment;
• You misuse or manipulate the booking system, membership privileges, or promotional offers.

16. Services, Pricing, and Availability

16.1 We strive to present our services accurately – whether it’s a teacher training course, an in-studio program, an online certification, or a private session. However, the exact nature of service delivery may vary depending on your goals, health status, physical condition, or learning needs. Descriptions on the website are general representations and not contractual guarantees.

This does not excuse errors due to negligence. If we deliver a service that is objectively different from what you ordered (e.g., incorrect course access or scheduling errors), we will address and resolve it promptly. See Clause 17.7.

16.2 Where applicable, you may be required to select from different service packages (e.g., class packs, course formats, payment plans). Not all services are available in every location, and some offerings are limited to select regions or timeframes.

16.3 We make no guarantee that services will always be available. Availability is subject to capacity, instructor schedules, platform updates, and seasonal adjustments. We recommend booking early and confirming availability before planning travel or other commitments.

16.4 All pricing is displayed in AED (United Arab Emirates Dirhams) unless otherwise stated. Pilates Academy® reserves the right, at its sole discretion, to determine, revise, and amend its pricing structure at any time without prior notice. Please note that international users may be subject to currency conversion fees or additional banking charges. Pilates Academy® is not responsible for such fees.

16.5 If there is a price change between the time you place your order and the moment payment is processed, we will honor the price shown at the time of order – unless the change was due to a technical error or miscalculation.

16.6 Pilates Academy® does not offer services to countries, regions, or individuals listed under UAE export restrictions or OFAC sanctions. We reserve the right to reject transactions from such jurisdictions or users.

16.7 Users under the age of 18 may not register or use this website without adult supervision. Accounts, bookings, or transactions made by minors without guardian consent may be canceled.

16.8 You are solely responsible for maintaining the confidentiality of your account credentials and for any actions taken under your account. If you suspect unauthorized use, notify us immediately.

16.9 This website is owned and operated by MI PILATES STUDIO DMCC, trading as Pilates Academy®, headquartered in Dubai, UAE.

16.10 All memberships, class packs, and service credits issued by Pilates Academy® are valid for a specified period from the date of purchase, as indicated at the time of booking or payment. Once the validity period expires, any unused services or credits will automatically expire and cannot be reactivated, transferred, or refunded, regardless of usage history.

17. Orders and Provision of Services

17.1 Any purchase made via our website, app, or directly with our team constitutes an offer to engage with our services. That offer is accepted only once you receive a written confirmation (typically via email). Until confirmation is sent, no contract is formed, and your order may be declined at our discretion.

17.2 Once confirmed, your order email will outline:

• A clear description of the selected service (e.g., course title, session type, workshop name)
• A breakdown of all costs, including any applicable taxes, processing fees, or add-ons
• Start and end dates (where applicable), or expected delivery times
• Your login credentials and instructions for accessing any digital content or live sessions

17.3 If we decline your order for any reason, no payment will be collected (or if it was, it will be fully refunded within 14 calendar days using the same method of payment).

17.4 Payment is collected:

• Immediately at checkout for all one-time services or class packages
• On the same day of each month for subscriptions or installment-based plans
• According to any special agreement outlined in your confirmation email

Please ensure your billing details are accurate and funds are available at the time of processing.

17.5 We aim to activate your service within 2–3 business days, or sooner if the product is delivered digitally. If delays arise (e.g., instructor availability, system maintenance, app issues), we will inform you via the contact method used during booking. Delays do not invalidate the agreement unless the service becomes impossible to deliver.

17.6 If your order includes digital content or training that begins within 14 calendar days of confirmation, you may be required to expressly waive your statutory cancellation rights in writing.

17.7 We are committed to high standards. If you believe you’ve received the wrong service or were granted access to the incorrect course, contact us immediately at info@pilatesacademydubai.com. We will investigate and correct the issue within five (5) business days.

17.8 For certain services (e.g., intensive certifications, specialized workshops, custom studio consultations), you may be asked to accept specific additional terms and conditions at the time of registration. These are legally binding and supplement this main Terms and Conditions document.

17.9 We provide technical and customer support through email, phone, and (where available) the Pilates Academy® App. While we aim to respond as promptly as possible, response times may vary based on volume, time zone, and the complexity of your request. We do not guarantee a fixed response window.

18. Cancellations and Refunds

18.1 If you are a consumer based within the European Union, you are entitled to a statutory “cooling-off” period of 14 calendar days. This begins the day your order is confirmed and a contract is formed between you and Pilates Academy®.

To cancel your order within this timeframe, you must notify us in writing at info@pilatesacademydubai.com. Your right to cancel is subject to the conditions listed below in Clause 18.2.

18.2 If you request that a service begins within the cooling-off period (for example, by accessing digital content or booking a session scheduled within 14 days), you agree to the following:

• 2.1 If the service is fully delivered during the cooling-off period, your right to cancel ends once the service is complete.
• 2.2 If you cancel after the service has started but before it’s completed, you will be charged proportionally for what has already been delivered. Refunds will be processed minus this amount.

Any applicable refund will be processed within 5 working days, and no later than 14 calendar days from the date we receive your cancellation request.

18.3 Once the 14-day cooling-off period ends, cancellations and refunds are governed by the specific terms of the product or service purchased. Certain services – such as discounted packages, promotional offers, or digital access – may be marked as non-refundable. These terms will be clearly stated at the time of booking.

18.4 We are transparent about refund eligibility at the time of purchase. If your booking or order falls under a no-refund policy, this will be clearly indicated on the service page or confirmation email.

18.5 If a class, course, or session is canceled by Pilates Academy® due to unforeseen circumstances (e.g., instructor illness, low enrollment, or force majeure), we will offer you the choice of rescheduling or transferring the credit to another service.

19. Privacy

Your privacy is important to us. All use of the Pilates Academy® website and app is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using our services, you acknowledge and agree to the terms outlined in the Privacy Policy.

20. Data Protection and Use of Personal Information

20.1 We handle all personal data in line with applicable data protection laws, including but not limited to the UAE Personal Data Protection Law (PDPL), and the General Data Protection Regulation (GDPR) where applicable.

20.2 By using our services or submitting your details through our website or app, you consent to the use of your personal information for the following purposes:

• 2.1 To deliver the service(s) you purchased, such as managing class schedules, sending course materials, or issuing certificates.
• 2.2 To process your payment securely through verified third-party platforms.
• 2.3 To communicate updates, important service information, or new offerings – unless you opt out of marketing communications.

20.3 You can unsubscribe from promotional emails at any time by clicking the “unsubscribe” link at the bottom of our messages, or by emailing us at info@pilatesacademydubai.com.

20.4 In limited cases – such as for credit-based purchases or payment installment plans – we may request consent to pass your information to a trusted financial partner for evaluation. This will never happen without your explicit approval.

20.5 We never sell your personal information to third parties. We may, however, share limited data with service providers who support our operations (e.g., scheduling platforms, analytics tools, or email software), all of whom are bound by strict confidentiality and data handling agreements. These third-party service providers are contractually obligated to use your information solely for the purpose of delivering Pilates Academy® services.

21. Changes to the Platform and Terms

We may update the website, app, services, or these Terms at any time to reflect changes in our offerings, improve user experience, or comply with legal requirements.

You are bound by any updated Terms from the moment you continue using our services after changes are published. We encourage you to review this page regularly. If changes are required by law, they will apply automatically to all pending and future orders.

Pilates Academy® also retains the right to correct typographical errors, outdated information, or pricing inaccuracies without prior notice. This includes adjustments made on product pages, promotional listings, or automated emails.

22. Platform Availability and Technical Performance

22.1 We do our best to keep the Pilates Academy® website and app available at all times. We use industry-standard cloud hosting and data protection measures to support a high level of uptime. Where possible, we will notify users of any planned system maintenance that may affect platform access.

That said, the platform is provided “as is” and “as available.” We do not guarantee that the site or services will always be uninterrupted or error-free, and we do not offer refunds solely due to temporary unavailability.

22.2 We are not liable for disruptions caused by factors beyond our control, including but not limited to:

• Internet service provider outages
• Cloud server failure
• Power interruptions
• System maintenance
• Natural disasters
• Cyberattacks
• Government restrictions

Force Majeure

Pilates Academy® will not be held responsible for delays or failure to perform its obligations if such delay or failure results from causes outside our reasonable control, including technical failures, pandemics, armed conflict, embargoes, or regulatory changes.

23. Limitation of Liability

23.1 To the fullest extent allowed by law, Pilates Academy® is not liable for:

• Loss or damage, whether direct or indirect, arising from your use of the website, app, or services
• Any missed classes, technical errors, or reliance on outdated or incorrect content
• Any business, financial, or consequential losses arising from our services

You access and use the website and its content at your own discretion and risk.

23.2 Nothing in these Terms limits our liability in cases of:

• Proven negligence resulting in death or personal injury
• Fraud or fraudulent misrepresentation
• Gross misdelivery of services as outlined in your confirmation or contract

23.3 If any clause in these Terms is found to be invalid, illegal, or unenforceable, that clause shall be removed from the agreement without affecting the rest. The rest of the document will remain valid and enforceable under UAE law.

24. No Waiver

If we choose not to enforce a part of these Terms at a given time, it does not mean we waive our rights to enforce that same part (or others) later. Any delay in exercising a right or enforcing a clause shall not be considered a waiver.

25. Precedence of Current Terms

These Terms replace and override any previous agreements, policies, or terms you may have received from us, whether digital or printed. If there’s a conflict between earlier versions and this one, the terms you’re reading now take precedence – unless otherwise stated in writing.

26. Rights of Third Parties

These Terms are personal to you and Pilates Academy®. No other party is granted any rights to enforce or benefit from them under any legal doctrine relating to third-party rights.

27.2 If you’ve agreed to receive marketing or updates from us, we may contact you from time to time with relevant offers, training opportunities, and announcements. You can unsubscribe at any time using the link in our emails or by contacting us directly.

28. Health and Medical Disclaimer

By participating in any classes, sessions, or activities offered by Pilates Academy®, you acknowledge and agree that:

• Participation is entirely at your own risk.
• You confirm that you are in good physical condition and capable of engaging in physical activity.
• You understand that physical exercise involves inherent risks, including (but not limited to) injury, illness, or even death.
• You are strongly advised to consult a qualified medical professional before beginning any exercise program, especially if you have pre-existing medical conditions, injuries, or are pregnant.

29. Governing Law and Jurisdiction

These Terms are governed by and will be interpreted in accordance with the laws of the United Arab Emirates. Any dispute related to these Terms, our services, or your use of the website or app will fall under the exclusive jurisdiction of the courts of Dubai, UAE.

The UAE is our country of domicile and all activities, contracts, and claims related to Pilates Academy® services are considered to have taken place in Dubai.
